New Local Laws 1, 2, and 3

Attached below are the newly enacted Local Laws 1, 2, and 3 of 2023. 


NOTICE IS HEREBY GIVEN that pursuant to the provisions of the New York State Village Law and Municipal Home Rule Law, and after a public hearing duly noticed and held in accordance with said laws, the Board of Trustees of the Village of Upper Nyack (the “Village”), on February 16, 2023 adopted Local Law 1 of 2023 which will become effective upon its filing with the New York State Department of State.  This local law amends various sections of the Village’s Zoning Law to: (1) clarify ambiguities or correct typographical errors in the current law; (2) improve administrative efficiency in processing certain types of applications; and (3) modify certain provisions pertaining to uses and structures, most notably moving the special use permit for the keeping of animals other than customary pets into the Zoning Law, and causing warehouses and self-storage facilities to be reclassified as special permit uses in the OB District.  Zoning Map amendments to add a designation for cluster subdivisions and to correct the location of a parcel of property in the OB Residential Overlay district were also included as part of this amendment.
