Local Law Adoption Public Notice

NOTICE IS HEREBY GIVEN that pursuant to the provisions of the New York State Village Law and Municipal Home Rule Law, and after a public hearing duly noticed and held in accordance with said laws, the Board of Trustees of the Village of Upper Nyack (the “Village”), on February 10, 2022 adopted the following local laws, which will become effective on April 15, 2022:

Local Law 2 of 2022, the Subdivision Law of the Village of Upper Nyack.  This law provides for the processes, procedures and standards that apply to new land subdivisions in the Village. 

Local Law 3 of 2022, the Planning Board Law of the Village of Upper Nyack.  This law provides for the continuation of the Village’s Planning Board and sets forth its procedures and authority. 

Local Law 4 of 2022, the Stormwater Management Law of the Village of Upper Nyack.  This law is a recodification and amendment of the Village’s Stormwater Management and Erosion Control regulations. 

Local Law 5 of 2022, the 2022 Zoning Law of the Village of Upper Nyack.  This law repealed the Village’s 1962 Zoning Ordinance as amended and establishes zoning requirements and regulations applicable in the Village.   The 2022 Zoning Law divides the Village into 10 zoning districts – 7 residence districts and 3 commercial districts-- and 2 overlay districts.  It provides for the use and bulk requirements that apply in each district.  It also provides for the processes and standards for special use permit and site plan review.  The 2022 Zoning Law continues the Village’s Zoning Board of Appeals (the “ZBA”) and authorizes the ZBA to grant use and area variances, hear appeals from the decisions of the Zoning Inspector, and make interpretations of the 2022 Zoning Law.  The 2022 Zoning Law also provides for the enforcement of its terms.
