NOTICE OF ADOPTION OF RESOLUTION SUBJECT TO PERMISSIVE REFERENDUM

NOTICE IS HEREBY GIVEN that at a regular meeting held on the 8th day of March, 2018, the Board of Trustees of the Village of Upper Nyack duly adopted a resolution, an abstract of which follows, which resolution is subject to a permissive referendum pursuant to Article 9 of the Village Law of the State of New York.

            The Board of Trustees of the Village of Upper Nyack authorized  the purchase of approximately twelve (12) acres from JAMES ORVILLE CASON which property is commonly known as 626 North Broadway, Upper Nyack, NY 10960 for public use, including but not limited to a new Village Hall, park land, and open space for the purchase price of $2,500,000.00 subject to obtaining a municipal bond for $2,500,000.00 for twenty (20) years at prevailing rates and subject to a permissive referendum and other terms and conditions set forth in the Contract of Sale.

RESOLUTION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF UPPER NYACK

ON MARCH 8, 2018

 

WHEREAS, JAMES ORVILLE CASON individually and as administrator of the Estate of HESTER C. HARING a.k.a. HESTER CLARK HARING is the owner of real property commonly known as 626 North Broadway, Upper Nyack, NY 10960 consisting of approximately twelve (12) acres between Midland Avenue and Broadway in Upper Nyack and also designated on the tax map as Section 60.05 Block 2 Lot 27; and

WHEREAS, the said JAMES ORVILLE CASON offered said real property for sale to the Village of Upper Nyack for the sum of $2,500,000.00subect to certain terms and conditions;

And

WHEREAS, the Village of Upper Nyack is interested in purchasing said real property for public use, including but not limited to, relocation of the village Hall, park land and open space which purchase would be subject to obtaining a bond for $2,500,000.00 for 20 years at prevailing rates and it would also be subject to a permissive referendum for both the purchase and the bond;

NOW, THEREFORE, the Board of Trustees unanimously approves the following resolution:

The Village of Upper Nyack is authorized to purchase approximately twelve acres from JAMES ORVILLE CASON commonly known as 626 North Broadway, Upper Nyack, NY 10960 for the sum of $2,500,000.00 subject to a bond for $2,500,000.00 and also subject to a permissive referendum for both the purchase and the bond;

The Board hereby authorizes the Mayor, Karen Tarapata and Village Attorney Robert P. Lewis, Jr. to negotiate the terms and conditions of the Contract of Sale and further authorizes Mayor Karen Tarapata to sign the Contract of Sale and any and all other necessary legal documents to consummate the purchase of the property.

On motion of Trustee Esmay and seconded by Trustee Diamond the above entitled Resolution was unanimously approved.
